Terms & Conditions

By requesting a quote, accepting a proposal, scheduling work, or otherwise engaging PurePro Design Inc. d/b/a PurePro Coatings ("PurePro"), you agree to these Terms & Conditions.

PurePro provides residential and commercial concrete floor coating services in the greater Pittsburgh, PA area, including surface preparation, coating application, and related finishing work.

All quotes are preliminary and subject to a final on-site inspection of the substrate and project conditions. Final pricing may be adjusted based on the condition of the concrete, required preparation, square footage measured on site, and any additional scope discovered during inspection.

Installation dates are scheduled in advance and are weather- and condition-dependent. Either party may cancel or reschedule with reasonable notice. If the owner cancels after materials have been ordered, the owner agrees to pay any non-returnable material costs and a restocking fee on returnable materials.

A deposit is due at proposal acceptance to secure the installation date. The balance is due upon completion unless otherwise stated in the proposal. Time for payment is of the essence; PurePro may stop work and pursue collection for any amounts not paid when due.

No date is provided unless specifically set forth herein. This contract may be terminated at any time for any reason by either party. If the contract is terminated by either party, PurePro Coating Co. ("PurePro") will be paid for work completed as of the date of termination. If the owner terminates the contract, the owner agrees to pay a re-stocking fee for all returnable materials. In the event that materials aren't returnable, the owner will pay the costs for the materials that have been ordered.

When pouring concrete, the owner or contractor shall complete any grading and compaction of sub-grade.

PurePro does not guarantee and shall under no circumstances be liable for work performed by others at the job site or for any work not included in this contract.

PurePro shall not be liable for damage to its construction and installation from storms, floods, fires, underground utilities, sprinkler lines, water overflow from gutters, acorns, tree sap, leaves, tree foliage, any damage incurred from pets (i.e. pet hair or footprints), etc. Any repairs or cleaning made necessary through no fault of PurePro shall be billed at field cost plus overhead +20% profit, which owner or contractor agrees to pay.

All decorative concrete finishes are intended to achieve a rustic effect. Some variations in finish texture, shading, flake distribution, along with other irregularities are likely to occur and are a part of the individuality of the installation. Concrete coatings may not cover existing cracks. Patched concrete irregularities (cracks, chips, holes, etc.) may show through a coating. These variations will not alter owner's or contractor's obligations hereunder.

Job site conditions (weather, humidity, concrete surface and installation techniques) greatly affect the appearance of the final color. Even on an individual job, the color may vary from one side of the floor to the other. We make no guarantees to match any particular color chart. Manufacturer color charts and physical samples are purely for reference, and the final color will likely vary from a chart or sample.

Time for payments of the price hereunder is of the essence. In the event payments of the price to be paid hereunder are not received when due, PurePro shall have the right to stop its work and to bring an action for the value of its work to the time of stoppage.

If PurePro seeks to collect any money due it hereunder through an attorney, by lawsuit or otherwise, owner or contractor agrees to pay all costs and reasonable attorneys' fees for collection efforts, litigation and appeals. If for any reason the owner or contractor seeks to collect any money from PurePro, the maximum amount shall be no more than the value of this contract, which would be a refund of all money paid to PurePro.

PurePro passes through the manufacturer's 10-year material warranty provided by Epoxy Depot on the coating products used in your installation, subject to the manufacturer's terms, conditions, and exclusions. PurePro does not provide a separate workmanship warranty. All other warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose, are disclaimed to the fullest extent permitted by law.

To the fullest extent permitted by law, PurePro's total liability arising out of or relating to the services shall not exceed the amount paid by the owner under the applicable proposal or invoice. PurePro is not liable for indirect, incidental, consequential, or lost-profit damages, or for slip-and-fall accidents, damage from storms, floods, fires, underground utilities, sprinkler lines, gutter overflow, tree debris, pets, or other conditions outside PurePro's reasonable control.
